A general power of attorney is a document which provides authority for someone, the attorney, to act on behalf of another, the donor.

The attorney can be given powers which are:

  • General powers that would allow the attorney to do anything that the donor could do;

OR

  • Specific powers that would stipulate exactly what the attorney is allowed to do on behalf of the donor.

An ordinary General Power of Attorney will cease upon the mental incapacity of the donor, they are generally created for a specific period of time, usually a year.
