It is probably fair to say that unless via friends or family you have had first hand experience of it, mental capacity is not a common concern, yet those suffering from various forms of dementia are on the rise as are serious accidents resulting in head injuries.
A Lasting Power of Attorney enables you to appoint people of your choice to make decisions about your personal welfare, such as health care and your financial affairs, when you are unable to do so.
If you have not made such provision and the worst happens, it can be a lengthy and costly process to apply to the Court of Protection to be granted power.
